SECTION 00100 – NOTICE TO CONTRACTORS

The Board of Education of Baltimore County invites Contractors to bid on the CONSTRUCTION OF A NEW SCHOOL - GEORGE WASHINGTON CARVER CENTER FOR ARTS AND TECHNOLOGY HIGH SCHOOL for Rebid #1 of the following Contract Package: 5A – Steel; [commodity code 91223 and others]; for Baltimore County Public Schools under Solicitation Number PCR-272-10. Procurement questions can be e-mailed to Ed Lurz at elurz@oakcontracting.com and simultaneously to Paul Cramer at pcramer@bcps.org . You must identify the bid number within your e-mail message. Verbal questions will not be taken.

The above package is a rebid of the original solicitation, PCR-264-10, which is hereby incorporated into this solicitation by reference. Contractors proposing to bid and who have not yet purchased PCR-264-10 and its two (2) addenda must do so. Both PCR-264-10 and PCR-272-10 may be obtained beginning Thursday, January 21, 2010, through www.bcps.org. Click on the “Our System” tab at the top right of the aforementioned web address, click on “Offices,” click on “Purchasing Office,” click on “Bid Board” on the left, and then click on the “Invitation to Bid.” Solicitation documents can be ordered electronically or picked up from Gardens Reprographics (419 St. Paul Place; Baltimore, MD 21202. Hours: Monday - Friday from 8:00 a.m. – 5:00 p.m. Phone: 410-539-2763).

A Prebid Meeting is scheduled for Thursday, February 4, 2010, at 11:00 a.m., at BCPS - Department of Physical Facilities, Office of Engineering & Construction, 9610 Pulaski Park Drive, Suite 204; Baltimore, MD 21220.

Sealed bids will be received until Thursday, February 25, 2010, no later than 2:00 p.m., in the Office of Purchasing at Baltimore County Public Schools, located at 1940 Greenspring Drive, Suite G; Timonium, MD 21093 for the following Contract Package: 5A – Steel. A public bid opening will be held approximately 10-minutes after the due date and time for this solicitation.

Certified Minority Business Enterprises are encouraged to respond to this solicitation notice. All Prime Contractors, including Certified MBE firms, when submitting bids or proposals as General or Prime Contractors, are required to attempt to achieve this goal from Certified MBE firms. The Contractor or Supplier who provides materials, supplies, equipment, and/or services for this construction project shall attempt to achieve the specific overall MBE goals as follows:

Package 5A – Steel shall attempt to achieve the specific overall MBE goal of 25% of the total contract value established for this project’s 5A Package. The subgoals established for this project’s 5A Package are 5% from certified African American-owned businesses, 5% from certified Woman–owned businesses, and the balance of 15% from all certified Minority Business Enterprises. The bidder or offeror is required to submit with its bid or proposal a completed Attachment A “Certified MBE Utilization and Fair Solicitation Affidavit” and Attachment B “MBE Participation Schedule”, as described in the solicitation documents.

Bidders shall reference Part II SPECIFICATION AND PROPOSAL SECTION 8.0. Certified Minority Business Enterprises.

All General Contractors and Subcontractors including Certified MBE firms when bidding as General or Prime Contractors are required to attempt to achieve the MBE subcontracting goals from Certified MBE firms approved by the Maryland Department of Transportation (MDOT).

The Bidder or Offeror shall submit, with its bid or proposal, a completed “Certified MBE Utilization and Fair Solicitation Affidavit” (Attachment A) and “MBE Participation Schedule” (Attachment B) that identifies the Bidder or Offeror’s specific commitment of certified minority business and certifies it made a good faith effort to achieve the goal established in the solicitation. The MBE Participation Schedule (Attachment B) shall include the name of each Certified MBE that will participate in the project including its respective MBE classification, and shall include the items of work to be performed or furnished and the committed price and/or the percentage of the contract to be paid to each MBE for the work or supply.

When the contract goals (per package) and/or its subgoals cannot be met, the Bidder or Offeror shall submit, with its bid, the Certified MBE Utilization and Fair Solicitation Affidavit, (Attachment A) and the MBE Participation Schedule (Attachment B) indicating partial or no participation. The Apparent Low Bidder shall submit additional Minority Business Enterprise material and supporting data specified in the bid documents within ten (10) working days after notification that the firm is the Apparent Low Bidder. The failure of a Bidder to complete and submit all of the required forms shall result in a determination that the bid is not responsive. The failure of an Offeror to complete and submit all of the required forms may result in a determination that the proposal is not susceptible of being selected for award.

The Board of Education of Baltimore County reserves the right to reject any or all proposals and to waive informalities.

Direction to Prebid at 9610 Pulaski Park Drive, Suite 204:

I-695 to Exit 35B, Pulaski Highway (Rte. 40) towards Aberdeen

Stay on Pulaski Highway 2.4 miles (be in the right lane) until you reach the stoplight at Middle River Road

Turn right at the stoplight onto Middle River Road and drive .1 mile

Turn left into Pulaski Business Park (off Middle River Road)—office is on the left.
